Jury Reaches Verdict: Stern and Eroshevich Found Guilty

After 13 days of deliberation, the jury returned a verdict in the drug conspiracy trial against defendants Howard K. Stern, Dr. Kristine Eroshevich and Dr. Sandeep Kapoor. The jury alerted Judge Perry that they reached a decision and read the verdicts yesterday afternoon. The jury first announced the acquittal of Dr. Sandeep Kapoor on all charges. Shortly after, the jury announced that Howard K. Stern had been found guilty on two felony counts of conspiracy – giving false names and acting by fraud to obtain prescriptions. Smith’s psychiatrist Dr. Khristine Eroshevich was convicted of the same two conspiracy charges and was also found guilty on two additional charges of “prescribing and furnishing sedatives and opiates to an addict.”

Sentencing for Stern and Eroshevich is scheduled for January 6, 2011.  A spokeswoman from the District Attorney’s office indicated that “both defendants are looking at possible maximum of at least three years in state prison.

According to the latest update from the Associated Press, the jury is asking questions about particular elements of charges against the defendants.   The jurors’ written notes indicate that they are struggling to reach a verdict.  Judge Perry has instructed them to declare a hung jury if they cannot reach a unanimous decision.  Perry even invited the jurors back for additional legal guidance or re-read of testimonies, if needed.  But as of now, there is no indication of when this may or may not happen.  Stay tuned for the latest!

Criminal Trial of Co-Defendants Stern, Kapoor & Eroshevich: Jury Update

Six days have gone by and the jury is still deliberating in the Anna Nicole Smith drug conspiracy case.  According to the Associated Press, there are 21 separate decisions the panel is evaluating regarding Smith’s former lawyer/lover Stern and Drs. Kapoor and Eroshevich.  Because there are multiple charges against each defendant, the jury will answer a list of questions as to why the defendants are found guilty, if convicted.  For instance, the jurors will be asked “to answer true or not true to whether the defendants conspired to unlawfully prescribe, administer or dispense a controlled substance to an addict.”  The jury must reach a unanimous decision on each charge and with the complex instructions given by Judge Perry, this lengthy trial may drag on.  As of now the jury talked for over 30 hours about the outcome – an outcome which is expected to “reverberate among doctors and pain management patients whose need for drugs is at the heart of California laws.”  Stay tuned for the latest trial updates!

Criminal Trial of Co-Defendants Stern, Kapoor & Eroshevich: Jury Update

Today is the third day of deliberations, and jurors are questioning the charges in the Anna Nicole Smith drug conspiracy trial. Jurors asked Judge Perry to explain the charges against Howard K. Stern for “unlawfully prescribing drugs” to Smith.  Clearly, the jury does not understand that Stern is charged as a co-conspirator and not an actual prescriber of medication.  The panel was told that “if they find either Dr. Sandeep Kapoor or Dr. Khristine Eroshevich guilty of prescribing drugs unlawfully, they may then consider whether Stern aided and abetted them.”  They were also told that a person “who aids and abets is equally guilty of a crime.”  Stay tuned for the latest!

Following closing arguments from both the prosecution and defense, Howard K. Stern’s fate now rests with the jury. In observance of Columbus Day, the jury isn’t expected to begin deliberating until tomorrow. As the trial draws closer to the end, please be sure to stay tuned for the latest!
