Criminal Trial of Co- Defendants Stern, Kapoor & Eroshevich: Day One

Today marks the first day of the criminal trial against co-defendants, Dr. Sandeep Kapoor, Khristine Eroshevich and Howard K. Stern- all charged with facilitating lethal amounts of prescription drugs to the former reality-TV star, Anna Nicole Smith.

During opening statements, Judge Robert Perry made clear that the defendants are not charged with Smith’s death.  It does remain clear, however, that the drugs administered by defendants were the cause of her tragic downfall.  Eleven different medications were found in Smith’s Hotel room at the time of her demise.

Deputy District Attorney, Renee Rose, claimed that the doctors continually prescribed Smith with medications despite being warned of her addiction issues.  As evidence, Rose showed the jurors pictures of powerful prescription drugs that were administered to Smith.  Rose also argued that Stern knowingly allowed the doctors to prescribe medication under aliases, despite her pregnancy.   During the prosecution’s two hour presentation, D.D.A. Rose said, “None of it could have happened without Mr. Stern.”

Stern’s defense attorney, Steve Sadow, says his client “simply trusted and relied on doctors to do what was best for Smith, who complained of serious, constant pain.”  Sadow further stated Stern was unaware that it is improper to use aliases to obtain prescription medications, and he also challenged Smith being labeled as an addict.  Given Smith’s publicly erratic behavior coupled with evidence of drugs on hand, such arguments should be difficult to prove to any jury.  A doctor is expected to testify on Smith’s ‘addiction’ during the trial.  Stay tuned…

    So is Sadow saying that Stern was such an ignorant “attorney”, not lay person as Sadow is quoted in reports, that he didn’t know it was illegal to get prescriptions in fake names. LOL

    Most lay people know that it is not legal.

    everyone knows it is illegal…to get prescriptions in phoney names…ignorance is not an excuse…by the way…Ms.Brenman…heard your legal
    analysis on kfwb radio this morning…and you really made some good points and clarified some issues and questions i had…good job!!!!

    What kind of attorney is Sadow that he expects us to believe that Stern did not know it was illegal for him to use a phony name to get prescriptions?
    Stern is a disgrace to attorneys. Kapoor is a disgrace to doctors. Eroshevitz is a disgrace to doctors.
    ***I hope they all go to prison.
    ***Will their poor fellow inmates be preyed upon? I am sure there are many tortured and tormented lost souls in there vulnerable to be preyed upon by vicious predators.

    Janice, Can you shed any light on what’s expected from Larry Birkhead’s testimony? Isn’t there a legal conflict of interest in that Stern is the executor of Anna’s/ Dannielynn’s estate?

  5. Interesting take on this “Circus” as you put it. It is a sad commentary to think that Anna Nicole Smith was living on drugs that were supplied by doctors and someone she trusted. Howard Stern was not her friend.

    As an addict, ANS would have gotten these drugs from someone else, if not from HS. Perhaps if he, or someoene else, had to drive to a crackhouse to get the drugs, he would have been less inlcined to do so. Everyone is at fault when it comes to enabling an addict.
