Lindsay Lohan: Playing A Role She Knows Well

A life graced by footlights and spotlights, coupled with an unstable familial foundation, is often underscored by the inability to follow socially responsible norms and mores.  The troubles of Lindsay Lohan bear no exception.  It appears she repeatedly attempts to negate her issues by struggling with sexual orientation, alcohol, and drug abuse.  Certainly one might be swayed to sympathize with her plight, and persuade her to manage her troubles by productive and constructive means.

The will of Lady Justice should not be continuously tried and tested, regardless of the excuse for insubordination.  Lohan’s missteps continue as follows, just to name a few:  failure to appear for her DUI conviction hearing in May allegedly due to a stolen passport; failure to consistently adhere to drug rehabilitation schedules; and, failure to accept culpability for erratic behavior while attributing youth and inexperience as the culprit.

Attorney Robert Shapiro, who made a career of defending the questionable behavior of his star-studded celebrities, provided no explanation as to why he quit his tenure as Lohan’s counsel – the day before she began a 90-day sentence in the L.A. County Jail.  She is, however, expected to be released soon due to “supposed” jail overcrowding.

Yesterday, prosecutors confirmed that she is ordered to report to a rehabilitation facility 24 hours after her release.   Her new lawyer, Shawn Chapman Holley, objects, claiming “it would only be fair” for the actress to spend some quality time with her family.  This proposed leniency all along the system’s chain of command does little to educate Lohan about repercussions stemming from making bad decisions.

Will Lohan’s celebrity again blind the hand which guides Lady Justice’s will, as it has for many a celebrity before her (as alluded to here: Daily Journal)?

The ANS Circus: Here Comes the Caravan!

Hurry, hurry!  Step right up for a chance to participate in one of the greatest spectacles to ever grace a courtroom!  Ladies and gentlemen, boys and girls, introducing the notorious network of defendants, Stern, Eroshevich, and Kapoor.  Each are charged with drug conspiracy related to the death of Anna Nicole Smith. You – yes, you! – could be called as a juror to decide their fate!

Los Angeles Superior Court Judge Robert Perry stresses that this is a high profile case involving a well-known media figure.  Here is a 15-page questionnaire to assess your qualifications (courtesy of E!): \”Jury Questionnaire\”

Besides the usual juror background check, we now ask you to submit to a series of questions involving your medical history (specifically as it relates to prescription medication), your views on the medical profession and the law, and any bias relating to the 3 individuals stated above. While Lady Justice awaits your responses, we remind you the opening gavel will be heard August 4.

Jim Brown vs. Electronic Arts: Fumbling Over Intellectual Property

In 2008, NFL legend Jim Brown filed suit against videogame manufacturer Electronic Arts (“EA”) for the use of his likeness in their Madden NFL title without consent.  EA claims they are shielded by the 1st Amendment to profit by including Brown’s likeness in its games.  Brown’s game-based jersey number and name are fictitious, but his team (Cleveland Browns), physical description and accomplishment described therein leave little doubt he is the subject.

Late U.S. District Judge Florence-Marie Cooper sided with the defendants in September 2009, and Brown appealed to the 9th Circuit.  Lady Justice has spotted the ball on the 20 yard line – could Brown add another proverbial rushing touchdown to his impressive collection?

Smith’s Doctor Will Stand Trial

Yesterday, Superior Court Judge David Wesley rejected Dr. Sandeep Kapoor’s defense motion to drop two charges in the case related to the death of former Playboy model Anna Nicole Smith.  Los Angeles prosecutors charged the trio of Kapoor, former attorney Howard K. Stern and Dr. Khristine Eroshevich with co-conspiracy for illegally providing Smith with a deadly mix of prescription drugs.  With this denial, the case against Kapoor will proceed as scheduled later this month.

In 2004, Smith came under Kapoor’s care after he took over her prior physician’s practice.  Kapoor’s questionable behavior started with prescribing the powerful, addictive opiate Dilaudid for six months after learning Smith cracked two ribs.  Kapoor claims he prescribed pills to Smith before he met Dr. Eroshevich, and later refused to sign a prescription list Eroshevich handed him.  He allegedly used a fictitious name for ANS’ prescriptions, but argues this act of “protection” does not support the drug charges.

Despite Kapoor’s plea of not guilty, the trial begins on August 4 and opening statements commence on August 5.  Only time will tell what comes next!

The Supreme Court: Locked and Loaded

Second Amendment supporters – you have something to hang your gun rack on.  Monday, the United States Supreme Court ruled that all 50 states have federal protection for the right to keep and bear arms.  Chicago and Washington D.C., were in favor of handgun bans, despite an obvious conflict with our Second Amendment which guarantees all citizens the right to keep and bear arms.

The NRA stated its opposition to Elena Kagan’s nomination, as well as Sonia Sotomayor’s during her confirmation process.  Both women favor gun control.  Predictably, Sotomayor was one of 4 dissenters in Monday’s decision.
