In a Los Angeles courtroom today, prosecutors began the preliminary hearing of three people involving ANS’ death by playing a video clip from the 2004 American Music Awards. It displayed ANS, slurred of speech, delivering a bizarre introduction to rapper Kanye West. This was meant as a visceral reminder to Superior Court Judge Robert J. Perry of the possibility of a drug-filled conspiracy that led to her untimely passing in 2007. All three defendants entered not guilty pleas last month.\”Three Ring Circus\”
California Department of Justice investigator, Danny Santiago, testified that in the days before ANS’ death in the Hard Rock Hotel in Florida, she appeared confused and isolated in her room, yet surrounded by a plethora of prescription drugs. Santiago went on to say that ANS staggered to the hotel, aided by defendant Howard K. Stern, who told an investigator he was feeding ANS the children’s electrolyte formula, Pedialyte, in a baby bottle. When ANS asked where her baby Dannielynn was, HKS advised her that the baby was left in the Bahamas while the two of them went to Florida to purchase a boat. HKS also told investigators ANS had complained of flu-like symptoms and was being treated with Tamiflu by one of ANS’ physician’s, defendant Dr. Khristina Eroshevich, who occupied the adjacent suite. At one point, Stern had to help ANS to the bathroom because she couldn’t get there, the witness said. A concerned Eroshevich wanted to contact a doctor to write a prescription (as she was not licensed in Florida), but HKS interceded, as he intended to keep any details of ANS’ condition out of the public eye. By the time the hotel staff thought it necessary to ascertain ANS’ condition, she was already in a rapid state of decline.
The preliminary hearing should take several weeks in order for Judge Perry to decide if there is enough evidence to proceed to trial. Apparently there are nearly 100 witnesses, defense and prosecution combined. Lady Justice will be waiting with bated breath as the details unfold.
Meanwhile, FBI records recently released under the Freedom of Information Act detail how ANS possibly plotted to kill her tycoon husband’s son, E. Pierce Marshall, as they battled for his father’s fortune. Marshall was at the center of a long legal fight to keep ANS from collecting his father’s multi-million dollar oil wealth before he died of natural causes in 2006. ANS vehemently denied the allegation when she was questioned on July 3, 2000. She cried that killing Pierce Marshall would have been a fruitless endeavor because the fortune would still be tied up in a trust, and – she believed – the court battle over the rightful heirs was nearly over. She told agents that the murder plot was fiction, created by a former disgruntled lover who was angry she broke off their relationship, according to the files. “Smith adamantly denied ever contemplating such a crime,” an agent wrote, and prosecutors eventually agreed the case against her could not proceed.
Stay tuned…

This past week, a former staffer on David Letterman’s late night talk program reported that the sardonic host engaged in various romantic trysts with female coworkers in a secret room perched above The Ed Sullivan Theatre, the Manhattan taping ground for the show.
The gap-toothed lothario married his longtime girlfriend, and former coworker, Regina Lawson earlier this year. Letterman apologized on-air to her on Monday stating she was “horribly hurt” by his behavior. Purportedly, all these romantic entanglements occurred before the couple recently exchanged vows.
Meanwhile, through a diary kept by Stephanie Birkitt, a former coworker and lover of Letterman’s, 48 Hours Mystery producer, Robert Joel Halderman, reportedly attempted to extort $2 million dollars from Letterman to keep quiet about these lascivious encounters. Ms. Birkitt, ironically enough, was a coworker and girlfriend of Halderman’s as well. Are you confused yet?
Last week, Halderman pled not guilty in a Manhattan courtroom to one count of attempted first-degree grand larceny and was released on a $200,000 bail bond. If the case goes to trial, then Halderman’s lawyer plans to claim that Letterman committed sexual harassment.
Because of his exploits and the scandal, Letterman is enjoying a surge in ratings. Lady Justice hates to admit the old adage is true: there is no such thing as bad publicity, except your own obituary.
