Upon questioning, Birkhead recalled being fearful for the condition of his then unborn daughter Danielynn, because ANS was taking a variety of drugs during her pregnancy to cope with the loss of her deceased son, Daniel. Shortly after Danielynn’s birth, Birkhead filed a paternity suit and included a declaration asking the child be tested for drugs. He feared ANS was not prepared to care for the baby. Birkhead earlier said ANS took more drugs than he had ever seen anyone take. But he chose to impregnate her regardless? Very strange.
During cross-examination, Birkhead described a peculiar phone call he received from Deputy DA Sarah Slice shortly after his testimony on Friday. Birkhead felt offended that DA Slice suggest he testify his daughter might be developmentally disabled because of the drugs prescribed by Eroshevich and Kapoor to ANS during pregnancy. It’s odd he felt offended when he just testified he was fearful about the condition of his unborn child. According to Birkhead, Danielynn is “very advanced, healthy and happy.”
Birkhead also claimed DA Slice encountered him in the elevator en route to today’s testimony, and insinuated he might be taking Stern’s side – which Birkhead denied – but not before saying “Anna could not speak for herself and the doctors had exploited her.” DA Slice was unavailable for comment outside court. He does have a history of “switching sides.”
The next witness, Dr. Nathalie Maullin, a psychiatrist who treated Smith during her 2006 pregnancy at Cedars Sinai Medical Center in Los Angeles, described her as a difficult patient. Dr. Maullin saw that ANS was a person going through obvious withdrawals from multiple medications when she was admitted. “When I asked her what she had been taking, she blew me off,” said Maullin, who recalled that Smith referred all questions to Stern.
Dr. Maullin telephoned Kapoor, who gave her a long list of drugs he prescribed to ANS including the addictive pain killer, Dilaudid, which surprised her since it is a powerful drug used for cancer patients. Kapoor stated ANS also had alcohol problems. The rollercoaster ride continues tomorrow…

Isn’t it amazing that Birkhead more or less knew she was an addict and knew her lifestyle, he claims to be an educated man, but yet impregnated her a second time! I hope the judge is making note of all this conflicting testimony because he really needs to decide who and what he is going to believe before he can apply the law. I certainly hope he does not believe Birkhead. Thanks so much for the coverage!
Larry certainly does seem to have a history of switching sides. First he was in the Dannielynn custody sweeptstakes for himself, then all of a sudden he and Howard got together and made peace and Larry was found to be the father. Afterward he and Howard appeared to be friendly and now he’s testifying in the State’s case against Howard. If Larry has any integrity at all he will he will set the record straight as to who was facilitating Anna’s extreme abuse of prescription drugs and he will note the roles played by Howard and the 2 doctors. Anyone who would prescribe/provide those sorts of meds to a pregnant woman deserves a lengthy jail sentence and anyone who doesn’t do anything they can to see that such a pusher was put in jail should be ashamed of themselves.
While some could see the multi-day questioning of Birkhead as silly- in fact, if it draws attention to the case, and the fact that those who supply celebs with prescription drugs in hopes of staying in their good graces will face the justice system, then good. If only there were criminal penalties for aiding and abetting frivolous law suits…we could try HKS for that too!
Britney Spears was lucky, MJ and Anna were not. Some laws need to change and disallow handlers to get away with this.
While Howard is smarter then most of them (sadly enough) and Larry’s lack of a center will help a good judge to make a solid decision, I hope they will allow Larry’s Florida statements,he is obviously not telling the truth. What burns me is – he is allowing Howard in DL’ life….The man who robed her of a mom is their friend. (puke) This man lacks Character.
