		<description>Seems to me like the probate court is the most equiped to handle this issue- it boggles my mind that the CA judge would even allow the case to go to trial when he knew that the other case was still pending. 
While the 9th circuit seems to be undergoing a shift, they seem to still have a lot of loose cannons at the lower levels.</description>
