The Big Top might be putting out a casting call for a new lion tamer. On December 18th, Judge David Wesley listened to a pre-trial motion from Deputy Attorney General E.A. Jones regarding the California Medical Board’s monitoring of Drs. Kapoor and Eroshevich, and how it is in the public’s best interest to suspend both licenses. Judge Wesley denied the motion and further admonished Jones for delivering poor oral and written arguments (complete with typographical errors). Ouch. One would have thought Jones utilized the extra week to prepare a proofed, effective presentation. Regardless, as stated in my last post, a criminal judge is not an extension of a state licensing board.
Lady Justice hopes this minor obstacle involving the Deputy AG (not the prosecutor) neither blinds nor biases Judge Wesley from having the trio’s (Stern, Eroshevich and Kapoor) nefarious activities reviewed in full, particularly in light of the serious criminal charges against each of them. In fact, it seems the interests of each defendant also conflict with one another, thus bifurcating the cases is the just thing to do. The opening gavel sounds February 5th, and we will be there to bring you the latest.

There appears to be misleading information floating through cyberspace with regard to Superior Judge David Wesley’s December 11th decision reported in ANS Circus: Driving in Tent Poles Once Again. To begin, a judge’s duties are not tied to the California Medical Board. He is entrusted to rule on the criminal matter at hand. His dismissal to rule on the possibility of having Eroshevich and Kapoor’s licenses’ suspended suggests neither innocence nor guilt. If they are found guilty, then the medical board can revoke their licenses. Information regarding the California Medical Board’s authority is located at http://www.medbd.ca.gov/laws/Index.html.
We will divulge information regarding the December 18th pre-trial motions once details become available.

Not surprisingly, the triumvirate of HKS, Eroshevich and Kapoor entered not guilty pleas today to 23 drug-related felony counts of drug conspiracy. Eroshevich and Kapoor won a small victory when Superior Judge David Wesley denied an attempt to revoke their medical licenses since Deputy Attorney General E.A. Jones III and a California state medical board delayed seeking action for over a year. Even though AG Jones felt it was imminently dangerous to the public for the doctors to continue practicing, he and the board refused to act sooner to determine whether testimony from the preliminary hearing warrants the case going to trial. Before the closing gavel sounded, Judge Wesley set a December 18th pretrial motion hearing and a tentative trial date of February 5, 2010.
Eroshevich’s attorney stated there was “simply no basis to prevent her from practicing medicine at this point. [This case] is related to a single patient, and on its face, it’s laughable [Eroshevich] would [be deemed] an imminent threat to the public.” Lady Justice fails to find the humor in any of this.
Kapoor’s attorney, Ellyn Garafalo, felt publicity may be a factor in the medical board’s “troubling” decision. Nonetheless, she was pleased with Judge Wesley’s decision to deny the license suspension motion. We will keep you abreast of all the action!

Dr. Conrad Murray, Michael Jackson’s personal practitioner at the center of a still-pending investigation into the pop icon’s death, resumed his cardiology practice Friday at the Armstrong Medical Clinic in Houston. He left his post in April to become MJ’s sole client for a whopping fee of $150,000 a month – monies he says were never received. Of course, he’s due that money – Hippocrates himself couldn’t have done a better job MJ, wouldn’t you say?
Murray’s attorney, Edward Chernoff, explains: “His legal fees are enormous and his debts have mounted to the point where it is unclear whether he will be able to keep his house or support his family. His intentions are to attend to these patients, who have continued to support him despite the attention and despite the threats.” What threats could there possibly be? Wouldn’t any high-priced patient be content to have a doctor administer any medicine deemed necessary to stay on the payroll?
Lady Justice hopes authorities will compile enough evidence to bring the good doctor to trial early next year. We, of course, will bring you the latest.

Today the dead body of 5 year old Shaniya Davis was found after a relentless, week long search by over 200 volunteers in Sanford, N.C.. Her own mother, Antoinette Nicole Davis, has been arrested for selling her as a sex slave. According to arrest documents she “knowingly provide[d] Shaniya Davis with the intent that she be held in sexual servitude.” Fayetteville, N.C., police have yet to report if said charges will be amended to include murder, as they should.
Can you believe Antoinette Davis is sitting in a North Carolina prison – pregnant AGAIN. She only recently took custody of Shaniya, according to the child’s father Bradley Lockhart, who said he raised her for the first four years of her life after a “one-night stand.” Apparently Davis recently secured a job and residence, so Lockhart decided to give her a chance. It was only about 5 weeks she took that “chance” and sold her own child. Reports also reveal drug dealing out of Antoinette’s home. I wonder how many times she has already done this…
Surveillance video also shows a man, Mario Andrette McNeill, carrying Shaniya through a hallway of the Comfort Suites in Sanford, N.C., just outside Raleigh. McNeill, 29, has only been charged with kidnapping at this point.
The tone of Antoinette’s voice on the recorded 911 phone call is void of any meaningful motherly concern whatsoever. I am stunned and disgusted at this horrific incident, yet children being sold for sex in this country is a dark ugly problem. Several months ago, on July 22, 2009, billionaire financier and pedophile, Jeffrey Epstein, 56, was freed from jail, 6 months short of his 18-month DEAL of a sentence. State law would have provided up to 10 years, which still isn’t punishment enough for this heinous and disgusting criminal. He pled guilty to procuring underage prostitutes and struck a deal with federal prosecutors. Deal? Sounds more like an escape from justice.
Both the FBI and U.S. Attorney’s Office agreed to call off their year long investigation into allegations that Epstein brought little girls to his Palm Beach mansion for sex. Interestingly, Epstein flew Bill Clinton to Africa on his private Boeing 727 in 2002. Do you think it’s how much money you have to pay off witnesses, or, perhaps is it who you know that is more important? What a sad state of affairs. I pray that parents who pimp their own children are prosecuted to the fullest extent of the law, and pedophiles like Epstein stop getting away with murder. Enough!
